Terms of Service
These Terms of Service (hereinafter referred to as the "Terms") set forth the terms and conditions for the use of the smartphone application "Sumineko" (hereinafter referred to as the "App") and related services (hereinafter referred to as the "Service") provided by yukapero.com (hereinafter referred to as the "Operator"). All individuals who use the Service (hereinafter referred to as "Users") agree to use the Service in accordance with these Terms.
Article 1 (Applicability)
1. These Terms shall apply to all relationships between the User and the Operator regarding the use of the Service.
2. In addition to these Terms, the Operator may make various rules and regulations regarding the use of the Service (hereinafter referred to as "Individual Regulations"). Regardless of their name, these Individual Regulations shall constitute a part of these Terms.
3. In the event of any conflict between the provisions of these Terms and the Individual Regulations, the provisions of the Individual Regulations shall prevail unless otherwise specified in the Individual Regulations.
Article 2 (Service Content and Restrictions)
1. Service Overview
The Service is a healing-focused video application that continuously plays curated cat videos just by opening the app. It provides a "watch-while-doing" experience through Picture-in-Picture (PiP) mode, allowing users to enjoy cat videos in the corner of the screen while performing other tasks, and features a collection system based on viewing activity.
2. Plans and Restrictions
The Service offers the following plans:
- Free Plan: All features are available, but the use of the Picture-in-Picture (PiP) feature is limited to 5 minutes per day (resets daily at 00:00).
- Pro (Paid): By making a one-time purchase, the time limit on the PiP feature is removed, allowing unlimited use.
Article 3 (Paid Plans)
1. Users shall pay the usage fee separately determined by the Operator and displayed within the App as consideration for the paid portion of the Service, using payment methods provided by Apple Inc. or Google LLC.
2. Once paid, the usage fee shall not be refunded for any reason, except as otherwise provided by law.
Article 4 (Prohibited Acts)
Users shall not engage in the following acts when using the Service:
- Acts that violate laws and regulations or public order and morals.
- Acts related to criminal activities.
- Acts that infringe on copyrights, trademark rights, or other intellectual property rights contained in the Service.
- Acts of unauthorized downloading, saving, reproducing, or redistributing the video content of the Service.
- Acts of using information obtained through the Service for commercial purposes.
- Acts that destroy or interfere with the functions of the Service's servers or networks.
- Acts that may interfere with the operation of the Service.
- Acts of unauthorized access or attempting to do so.
- Acts that cause disadvantage, damage, or discomfort to other Users or third parties.
- Other acts deemed inappropriate by the Operator.
Article 5 (Disclaimer)
1. The Operator does not expressly or implicitly guarantee that the Service is free from de facto or legal defects (including defects, errors, bugs, or infringements of rights related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc.).
2. While the Service aims to provide relaxation, individual results vary, and it does not guarantee any medical or scientific effects.
3. The Operator shall not be liable for any damages incurred by the User arising from the Service, except in cases of intentional or gross negligence by the Operator.
Article 6 (Communication Fees)
All communication fees, including packet communication charges incurred by using the App (such as watching videos), shall be borne entirely by the User.
Article 7 (Changes to the Terms)
The Operator may change these Terms without prior notice to the User when deemed necessary. The modified Terms shall become effective at the time they are posted within the App.
Article 8 (Prohibition of Assignment of Rights and Obligations)
The User may not assign or transfer their position under these Terms or their rights or obligations under these Terms to any third party.
Article 9 (Severability)
Even if any provision of these Terms is deemed invalid, the remaining provisions of these Terms shall continue to be fully effective.
Article 10 (Changes to Service Content, etc.)
The Operator may change the content of the Service or discontinue the Service without notifying the User, and shall not be liable for any damages incurred by the User as a result.
Article 11 (Governing Law and Jurisdiction)
These Terms shall be interpreted in accordance with Japanese law. In the event of any dispute regarding the Service, the court having jurisdiction over the location of the Operator (Tokyo District Court) shall be the exclusive agreed court of first instance.
